The California Consumer Privacy Act (CCPA) is a comprehensive data privacy law that gives residents of California specific rights over how businesses handle their personal information. It empowers consumers to know what categories and specific pieces of personal data are collected about them, as well as the purposes for which that data is used and the third parties with whom it is shared. The CCPA also allows individuals to request access to their personal information, ask businesses to delete that information (subject to certain exceptions), and opt out of the sale or sharing of their personal data. In addition, the law prohibits businesses from discriminating against consumers who exercise these rights, such as by charging higher prices or offering lower quality services.
The statute applies primarily to for-profit entities that do business in California, collect personal information from California residents, and meet defined economic or data-processing thresholds. In general, a business is covered if it exceeds a specified annual gross revenue threshold (adjusted periodically for inflation), processes personal information of at least 100,000 California residents or households in a year, or derives 50% or more of its annual revenue from selling or sharing consumers’ personal information. These criteria are intended to capture larger or data-intensive organizations while excluding smaller entities with limited data activities.
